USCIS Postpones Updated NTA Policy

Today USCIS announced it is postponing the implementation of an updated policy regarding the issuance of Notices to Appear (NTA). The revised policy instructed USCIS to issue NTAs for several categories where individuals qualify as removable. Notably, USCIS included cases in which upon the denial of an application or petition, an applicant is unlawfully present in the United States.
In today's announcement, USCIS noted it has not yet issued operational guidance on the new NTA policy. As a result, USCIS is temporarily postponing the implementation of the June 28, 2018 NTA policy memorandum until it issues the required operational guidance.
